1. Agreement to these terms

These Terms of Service govern your access to and use of Pointerly websites, applications, APIs, dashboards, browser extensions, automation features, Creator Connect tools, integrations, and related services. By creating an account, joining a workspace, connecting an account, or using the service, you agree to these terms. If you use Pointerly for an organization, you represent that you have authority to bind that organization.

2. The service

Pointerly provides smart links, bio pages, analytics, affiliate and commerce tools, AI-assisted content, Creator Connect workflows, brand campaign management, reporting, automations, and integrations. We may improve, modify, suspend, or discontinue features as the product evolves, including when required by a third-party platform, security concern, or legal obligation.

3. Accounts, teams, and authority

You must provide accurate account information, keep credentials secure, and promptly update account details. You are responsible for activity under your account and for users invited to your team or workspace.

  • You must be at least 18 years old or otherwise able to enter a binding agreement.
  • You must have authority to connect any social, affiliate, advertising, commerce, storage, CRM, email, analytics, or messaging account used with Pointerly.
  • Workspace owners and admins are responsible for roles, permissions, connected destinations, exports, and team member activity.
  • You must notify us promptly if you suspect unauthorized access to your account or workspace.

4. Customer content and data

You retain ownership of content and data that you submit to Pointerly, including links, pages, campaign information, creator or brand profiles, media, analytics imports, and workspace records. You grant Pointerly a limited license to host, process, display, transmit, and use that content only as needed to provide, secure, support, and improve the service.

You are responsible for ensuring that your content, imports, exports, campaigns, claims, offers, promotions, and messages comply with applicable law, platform policies, advertising rules, disclosure requirements, and rights of third parties.

5. Connected accounts and integrations

Pointerly can connect to third-party services at your direction. By connecting a service, you authorize Pointerly to access, process, and transmit the data needed to provide the integration. You may disconnect integrations where the product allows, and some functionality may stop working after disconnection.

  • You are responsible for the accuracy and lawfulness of data you import into Pointerly.
  • You are responsible for destinations you connect, including Google Sheets, Drive, Notion, Airtable, Slack, Discord, HubSpot, Mailchimp, Dropbox, OneDrive, Zoom, Trello, Google Analytics, and similar tools.
  • Third-party services are governed by their own terms and privacy policies. Pointerly is not responsible for third-party service failures, policy changes, rate limits, outages, or account restrictions.
  • You must not use integrations to bypass platform restrictions or export data to a destination where you lack permission.

6. Affiliate, advertising, and partner platform data

If you use Pointerly with affiliate networks, social platforms, Amazon Associates, Amazon Advertising, Amazon Creator Connections, Meta, TikTok, Shopify, or other partner platforms, you must comply with the applicable program terms, API policies, ad policies, brand guidelines, data protection rules, and disclosure obligations.

  • You represent that you have the right to connect the relevant account and process the related data in Pointerly.
  • You must not re-export, resell, disclose, or use restricted partner data in violation of platform policy or applicable law.
  • Amazon Ads API and Creator Connections-derived data is treated as restricted partner data inside Pointerly.
  • Pointerly blocks automated third-party exports of restricted Amazon partner data by default. Any allowed export must be explicitly initiated by the customer and sent only to the customer's connected destination.
  • Official Amazon Creator Connections API sync is available only after Amazon grants the required app approval, scopes, and endpoint access.

7. AI-assisted features

Pointerly may provide AI-assisted content, analysis, summaries, recommendations, or automation features. AI outputs may be incomplete, inaccurate, or unsuitable for a particular purpose. You are responsible for reviewing and approving AI-generated content before publishing, sending, relying on, or using it in campaigns, public pages, legal notices, disclosures, or business decisions.

8. Acceptable use

You may not use Pointerly to:

  • Violate law, infringe rights, mislead consumers, or breach third-party platform policies.
  • Send spam, phishing, malware, deceptive links, or unauthorized messages.
  • Collect, scrape, or process data without appropriate rights, notices, consents, or authority.
  • Attempt to access accounts, systems, data, or APIs without authorization.
  • Reverse engineer, overload, interfere with, scan, or disrupt the service except as permitted by a responsible security disclosure process.
  • Publish unlawful, harmful, abusive, discriminatory, sexually exploitative, violent, or fraudulent content.
  • Use Pointerly to build a competing service by copying product functionality, interfaces, or non-public information.

9. Plans, billing, and taxes

Paid plans are billed in advance unless stated otherwise. You authorize Pointerly and our payment processor to charge applicable fees, taxes, overages, add-ons, and renewals. Fees are non-refundable except as required by law or expressly stated in a separate agreement. We may change pricing or plan limits with notice, and continued use after the change means you accept the updated pricing.

10. Suspension and termination

We may suspend or terminate access if we reasonably believe you violated these terms, created risk to the service or others, failed to pay, used the service unlawfully, or caused a third-party platform or provider to require restriction. You may stop using the service at any time and delete your account where the product supports deletion.

11. Intellectual property

Pointerly and its software, design, trademarks, logos, documentation, and platform features are owned by Pointerly or its licensors. Except for rights expressly granted in these terms, no rights are transferred to you. You may not remove notices, copy protected elements, or use our marks in a way that suggests endorsement without permission.

12. Confidentiality and security

You must protect non-public Pointerly information, API keys, credentials, tokens, and workspace data. Do not share credentials, hard-code secrets, place secrets in public repositories, or allow unauthorized users to access connected accounts. Pointerly maintains security controls described on our Security page, but you remain responsible for securing your users, devices, accounts, and destinations.

13. Disclaimers

The service is provided "as is" and "as available". To the maximum extent permitted by law, Pointerly disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and availability of third-party services, APIs, approvals, accounts, data, or results.

14. Limitation of liability

To the maximum extent permitted by law, Pointerly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, business interruption, third-party platform action, or unauthorized use of customer-controlled destinations. Pointerly's total liability for claims arising from the service is limited to the amounts paid to Pointerly for the service in the twelve months before the event giving rise to the claim.

15. Indemnity

You will defend, indemnify, and hold Pointerly harmless from claims, losses, liabilities, damages, costs, and expenses arising from your content, connected accounts, exports, campaigns, misuse of the service, breach of these terms, violation of law, or violation of third-party rights or platform policies.

16. Changes

We may update these terms from time to time. We will update the date above and provide additional notice where required. Continued use of Pointerly after changes take effect means you accept the updated terms.
